Remote support and the Swiss FADP

The Swiss Federal Act on Data Protection also applies to remote maintenance. Here is what to understand — and the questions to ask before choosing a tool. This guide is informative and does not replace legal advice.

What is the FADP?

The revised Swiss Federal Act on Data Protection (nFADP) has been in force since 1 September 2023. It governs the processing of personal data of natural persons; its scope depends in particular on the processing's connection to Switzerland. It strengthens people's rights (information, access and, under certain conditions, erasure) and imposes transparency and security obligations on companies that process data.

What it changes for remote maintenance

During a support session, the screen, files and actions on the machine may contain personal data. Two questions frame the topic: who is responsible for that data, and who can access it. As a rule, your SME remains responsible for its clients' data; the support tool must provide documented guarantees: encryption, hosting, logging, privacy policy.

Questions to ask a provider

Where is the data hosted? Who can access it, and under which law? Is session content encrypted end to end? What data is logged, and for how long? Is there a complete privacy policy and documented subprocessors? A provider should be able to answer these questions precisely.
